MEDIA RELEASE \u2013 Right to Silence is precious: but Integrity Commission must be able to compel answers, 18 June 2026<\/h1><\/div><\/div>\n\n

Statement by Peter George, Independent MP for Franklin:<\/span><\/b>\u00a0<\/span><\/p>\n

Long-overdue proposed changes to Tasmania\u2019s Integrity Commission\u00a0leave\u00a0the state out of step with mainland state and federal integrity bodies and much weaker.<\/span>\u00a0<\/span><\/p>\n

Recommendations to strengthen the Integrity Commission\u2019s work first proposed in 2016 removed the right to silence for witnesses before the commission, while preserving protections from self-incrimination.<\/span>\u00a0<\/span><\/p>\n

That recommendation informed the original draft amendments circulated by the Attorney-General\u00a0but the draft tabled in Parliament today has omitted the change.<\/span>\u00a0<\/span><\/p>\n

I\u2019ll\u00a0be seeking meetings with the Attorney-General to understand why\u00a0there\u2019s\u00a0been a change of heart as it clearly weakens the ability of the Integrity Commission to do its job\u00a0well.<\/span>\u00a0<\/span><\/p>\n

The decision to omit the right to compel evidence flies in the face of reforms first proposed by the Cox Report in 2016 and that have been sitting on the shelf ever since.<\/span>\u00a0<\/span><\/p>\n

The absence of the measure\u00a0substantially weakens\u00a0the Integrity Commission\u2019s work of holding public figures - including MPs and ministers - to account for their actions and deeds.<\/span>\u00a0<\/span><\/p>\n

The Cox recommendations maintained a balance between personal freedoms and enabling the Integrity Commission to do its work properly, adopting a well-established model used by anti-corruption and integrity agencies around the country: individuals can be compelled to answer questions, but those answers cannot generally be used against them in subsequent criminal proceedings.<\/span>\u00a0<\/span><\/p>\n

This strikes\u00a0an appropriate balance\u00a0between individual rights and the public\u2019s right to\u00a0an honest, accountable government.<\/span>\u00a0<\/span><\/p>\n
